建筑工程消防設計備案辦事指南 一、受理范圍 1.依法應當辦理施工許可證， 不需要消防行政許可， 按照國家建設工程消防技術標準需 要進行消防設計的建設工程，有新建、擴建、改建 (含改造、室內外裝修、建筑保溫、用途 變更 )等活動的，都應該納入消防備案監(jiān)管范圍。建設工程消防備案不適用住宅內裝修、村 民自建住宅、救災和其他非人員密集常場所的臨時性建筑的管理。 根據《建設工程消防監(jiān)督管理規(guī)定》和《建筑工程施工許可管理辦法》 (建設部令第 71 號)及云南省政府規(guī)定，以下建設工程可以不申請辦理施工許可證，可以不進行消防設計、 竣工驗收消防備案 :(1) 工程投資額在 100萬元以下的建設工程 ;(2) 建筑面積在 1000 ㎡以下 的建設工程。其中對工程規(guī)模的判斷，應以《建設工程規(guī)劃許可證》或相關職能部門批準文 件內容為準。 禁止將應當實施行政許可的建設工程項目拆分或變相拆分為幾個項目實施建設工程消
